1. Confirmation

By confirming your order, a binding agreement is entered into (“the Order”). When we have received your Order, you will receive an automatic e-mail confirming your Order. We reserve the right, without legal consequences and at our discretion, to cancel your order. Should we be unable to deliver in accordance with the terms in the confirmation of your order, we will inform you, and if possible, offer you alternative product.

2. Trade with private individuals

Kimbrer Computer only deals with companies that have a valid VAT number, and thus not with private individuals. This means that our prices are always stated without VAT.

3. Payment

Kimbrer Computer offers the following payment options:

PayPal:

If you are using Paypal as your payment method, you will be automatically redirected to your PayPal account. We handle your order immediately upon receipt of payment confirmation. Please note: Your registered PayPal address must match your requested shipping address.

Credit cards:

We accept payments with Mastercard Visa, MasterCard & Maestro. Credit cards are charged in full upon dispatch of goods from our warehouse.

To ensure protection of your credit card information, your personal data is encrypted via SSL server and is therefore protected from access by third parties.

Kimbrer Computer's payment solution is based on the SSL standard, meaning that the information given in connection with the payment transaction is protected by encryption. SSL is the industry standard for secure payment and has been chosen accordingly.

Bank transfer:

We accept payment via bank transfer. Once payment is received on our bank account, the goods will be sent via the chosen freight method.

4. Pricing

All displayed prices do not include VAT, do not include service, payment or delivery charges. Kimbrer Computer retains the right to change prices at any time and reserve the right to cancel any order at our discretion. We do our best to ensure accuracy of all pricing, product specifications, inventory and product condition. Prices are displayed in the following currencies:

  - Danish Kroner (DKK)
  - EURO (EUR)
  - US Dollars (USD)

 

5. Product Specifications and Condition

Unless otherwise stated, all products offered for sale are refurbished or pre-owned products. All of our refurbished hardware is extensively tested, cleaned, and covered with our money back guarantee.

All specifications made available by us are indicative, and deviations may occur. You are only obliged to accept such deviations if these do not have a significant negative value deterioration for the product.

If you require new factory sealed product, please contact us here to receive a quotation.

6. Tax (VAT) Exempt Purchasing

For companies purchasing outside of Denmark, we offer VAT (tax) free purchases to the extent permitted by law. In order to qualify for VAT exempt purchases, a valid company VAT number must be supplied during the checkout process. VAT (Tax) free prices do not include service, payment and delivery charges. 7. Local Tax (Import Duties)

Please note that local charges (customs duty, sales tax) may apply, depending on your region and local import rules. All charges with regards to import are the responsibility of the purchasing company. We cannot and will not lower the package's value on the customs declaration in order for you to avoid additional charges. Please contact us here for further questions.

8. Delivery (Shipping)

All purchased items are dispatched within 24 hours.

For all European orders, a shipping fee of 10 € (Standard shipping) or 20 € (Express shipping) will be added. For orders that are shipped outside of Europe, shipping charges may vary.

Kimbrer Computer use UPS and TNT for most small parcel deliveries. For larger shipments, courier service may be required.

The order is expected to be delivered in accordance with the delivery date set out in the order if any, but the delivery time is indicative, and delays may occur.

9. Retention of title

All products provided under an Order are subject to retention of title. We retain full legal title to and beneficial ownership of each unit notwithstanding the delivery to you and possession and use of the unit by you. The retention of title remains in force until you have paid the total remuneration for the affected unit, including applicable interest, costs and expenses.

10. Breach and remedies

You must examine the product without undue delay from the time of delivery. Your remedies for breach, including for defects and delay, expires if notice hereof is not received without undue delay after the breach was discovered or ought to have been discovered. Our liability for breach, including for defects and delay, expires no later than 12 months after the time of delivery of the product in question and in any case no later than 1 months after the time where the breach occurred.

Should your product have a defect (defect at the time of delivery) within the given warranty period, please contact us here for return instructions.

To the extent we fail to remedy a breach, you may claim a refund of the purchase price. You have no further rights due to defects in the product.

If you report a non-existing or non-reproducible defect, we may claim payment for the time and materials spent in relation hereto.

 

11. Warranty

All of our products come with a one-year warranty, starting from the date of purchase, unless otherwise stated. This warranty covers any defects in materials or workmanship that may occur during the normal use of the product.

For configured servers and storage units, bought after 1st of March 2023, we offer an extended three-year warranty, also starting from the date of purchase. This additional coverage is a testament to the quality of our customized solutions and our commitment to ensuring that our customers have the reliability and performance they need. In order to obtain the three-year warranty, your configuration order must be placed online on our webshop. 

Please note that our warranty does not cover any damage caused by misuse, accident, or unauthorized modification or repair. Additionally, our warranty is limited to the cost of the product and does not cover any indirect or consequential damages, including lost profits, data loss, or other economic losses.

To make a warranty claim, please contact our customer service team at sales@kimbrer.com with your order number and a detailed description of the issue you are experiencing. We will work with you to troubleshoot the problem and provide a solution, which may include repair, replacement, or refund, at our discretion. Every replacement or repair is done at Kimbrer Computer at Messevej 12, 9600 Aars, Denmark. Kimbrer Computer cannot do any repair or replacement at your location. 

12. Limitation of liability

We are not liable for any indirect, or consequential damages, including your lost profits or revenues, anticipated revenues, operating loss, loss of goodwill, business interruption, diminished business value or loss of data.

Our liability in respect of any matters arising out of or in connection with an Order, whether based on contract, indemnity, statute, or otherwise, is limited to an amount corresponding to 100 % of the payments received by us under the order.

The limitations of liability do not limit our liability in relation to gross negligence, willful misconduct or fraud.

13. Product Liability

To the extent permitted by law, we have no liability arising out of any injury to individuals or property as a result of the ownership, possession, or use of any product manufactured, sold, leased, or delivered by us.

14. Force majeure event

We are not in breach of any obligation to the extent and for the duration prevented from performing the obligation due to a force majeure event.

Force majeure events include acts of God, war, mobilization, breakdown of telecommunication/infrastructure, external security events (e.g. hacker attacks, attack by computer viruses or other third-party destructive behaviour) and similar conditions, health and safety restrictions and recommendations issued by public authorities, pandemics, epidemics, natural dis-aster, strikes, lock-out, fire, damages to production plant, import and export regulations and other unforeseeable circumstances beyond the control of the party concerned.

15. Returns

Should a product require returning to us for any reason, you must contact us before returning the product here.

After we have received notification of your product return, you will receive a return merchandise authorization (RMA) number with shipping instructions via email. After receipt of your RMA number, you have 14 days to return to the product to us. Kimbrer Computer reserves the right to reject your RMA should the goods be returned outside of the 14-day return period. The RMA number must be clearly referenced on the packaging of the returned goods. Upon approval of your claim, a similar (non-defective) product will be sent. If we are unable to provide a product replacement, your payment will be refunded. More information on our Return Policy can be found here.

16. Newsletter subscription

This policy explains how we (Kimbrer Computer) use any personal information we collect about you when you register to receive email newsletters from us.

By subscribing to our newsletter, you consent to the collection, retention and use of your personal information in accordance with the terms of this policy. The aim of our newsletter service is to keep our customers and visitors updated on the latest news, special offers and information about our products and services. The subscription to our newsletter service is not mandatory.

Frequency:

The frequency of the newsletter issues will be once every two months.

Limited Liability:

We reserve the sole right to either modify or discontinue the newsletter at any time with or without notice to you. We will not be liable to you or any third party should we exercise such right. Any new features that augment or enhance the then-current services on this site shall also be subject to these Terms of Use. We also reserve the sole right to unsubscribe users / visitors from our newsletter service, without notice. We will do so with any subscriber we deem registered with fake data.

Double opt-in:

We require all subscribers to confirm their name and email address upon registration. You should then receive an email message from Kimbrer Computer. Click the unique link provided in this email message to finish verifying your email address.

Unsubscribing:

You can change your subscription settings or opt out from further communications at any point by selecting the unsubscribe link at the bottom of the newsletter. You can also contact us directly to request that you are removed from our mailing list.

 

17. Governing law and disputes

Any order is governed by and construed in accordance with the law of Denmark except for (a) rules leading to the application of other law and (b) the United Nations Convention on Contracts for the International Sale of Goods (CISG).

Any dispute controversy or claim arising out of or related to an order must be settled by the ordinary courts in Denmark and by our venue.

18. Changes to these Terms & Conditions

Kimbrer Computer reserves the right to change or modify the Terms and Conditions without prior notice.
